很多申请人明知在PERM过期的情况下USCIS不允许获得第二个visa category(只能修改
之前的category),还继续file I-140来获得新visa category。而出于赚钱的目的,
律师对此也抱着含糊其辞的态度。这种行为已经违反移民法。在美国这个法治国家,对
任何违法行为,任何人都有义务进行举报。下面是一封举报信,信的末尾有移民局、移
民局监察官、国土安全局的email、fax和通信地址。我们是一个自发成立的小组,已经
给上述监管机构多次发信,并正在联系对调查移民欺诈有兴趣的议员。希望这里有正义
感、敢于和移民欺诈做斗争的朋友继续转发此信,以获得更多关注,彻底打击移民欺诈
、造假行为。

Dear Sir or Madam,
As a US immigration official, I believe fighting against immigration frauds
is one of your honorable job duties. Recently a large wave of immigration
frauds is taking place, therefore I kindly request you help investigate.
As China Employment Based Third (EB3) classification cut-off date is moving
faster than Second (EB2) classification, to take such advantage, a large
number of Chinese EB2 applicants with expired Labor Certificates are filing
new I-140 petitions to acquire EB3 classifications, and meanwhile keeping
their EB2 classifications valid, which is ILLEGAL and explained here:

USCIS Adjudicator's Field Manual [see reference 1 below] defines:
USCIS will reject Form I-140 petitions that require an approved labor
certification if the labor certification has expired,
Except:
An amended petition is filed to request a different visa classification than
the visa classification requested in the previously filed petition;

The USCIS Manual explicitly defines that, for an applicant with expired
Labor Certificate, I-140 can only be filed to amend his/her visa
classification, which means such applicant cannot file I-140 to acquire new
classification (EB3) while keeping his/her previously-approved
classification (EB2) valid. However, recently more than one thousand Chinese
applicants are filing new (rather than amended) I-140 petitions to acquire
EB3 classifications, even though they were already approved in EB2 and their
Labor Certificates have expired long ago.
What is worse, many of these petitions were already wrongly approved in past
two months, resulting in people having two visa classifications illegally.
Some of these petitions were approved under Premium Processing, which is an
extra-paid service with much shorter review time.

HOW TO IDENTIFY SUCH ILLEGAL I-140 PETITIONS?

(1) petitions were filed to USCIS Nebraska Service Center and Texas Service
Center during the past two months (Dec 2013 and Jan 2014) and such filings
are still going on
(2) petitioners are Chinese
(3) petitions are acquiring EB3, although the petitioners were already
approved in EB2, and their Labor Certificates have expired

For the sake of enforcing immigration law of the United States, I kindly
request you help investigate these fraud cases, or forward this letter to
someone you know more proper.
